PERM Denial: Understanding Your Appeal and Reapplication Options
When a PERM labor certification is denied, applicants have two main options: filing a Request for Reconsideration or an appeal to the Board of Alien Labor Certification Appeals (BALCA). Understanding these pathways is critical for EB-3 applicants.
A PERM denial can be a significant setback for EB-3 employment-based immigration applicants, but it does not necessarily mean the end of the road. When the Department of Labor (DOL) denies a PERM labor certification application, employers and their legal counsel have structured options available to challenge the decision and potentially move forward with the green card process.
The first option available after a PERM denial is filing a Request for Reconsideration directly with the DOL's Office of Foreign Labor Certification (OFLC). This request asks the same adjudicating body to review the denial based on existing evidence or new supporting documentation. This option is generally faster but is limited in scope, as it typically involves clarifying factual issues or correcting administrative errors rather than introducing entirely new legal arguments.
The second and more formal option is appealing to the Board of Alien Labor Certification Appeals (BALCA). A BALCA appeal allows the employer to present legal arguments challenging the basis of the denial before an administrative law judge. This process is more rigorous and can take considerably longer, but it provides a broader opportunity to contest the DOL's reasoning and establish precedent.
In some cases, rather than appealing, employers may choose to refile a new PERM application with corrected recruitment procedures or documentation. This approach resets the process entirely but avoids the uncertainty of appeals. The decision between appealing and refiling depends on the specific reason for denial, the priority date implications for the beneficiary, and the strength of the legal arguments available.
EB-3 applicants facing a PERM denial should consult with an experienced immigration attorney promptly, as strict deadlines apply to both reconsideration requests and BALCA appeals. Acting quickly and understanding the specific grounds for denial are essential first steps in determining the most viable path forward.
