For the current fiscal year, the worldwide employment-based preference immigrant limit stands at a minimum of 140,000 visas annually, as established under the Immigration and Nationality Act. The per-country limit remains set at 7% of the combined family-sponsored and employment-based annual limits, equating to 25,620 visas per country.
USCIS will specify on its website whether applicants may use the 'Dates for Filing Visa Applications' charts rather than the standard 'Final Action Dates' charts. EB-3 applicants should monitor uscis.gov/visabulletininfo to confirm which chart applies before submitting adjustment of status applications.
Four chargeability areas remain oversubscribed and subject to per-country visa prorating provisions: China (mainland born), India, Mexico, and the Philippines. EB-3 applicants chargeable to these countries typically face significantly longer wait times than rest-of-world applicants.
Allocations in the July bulletin were based on demand received by June 3rd, processed in chronological order of reported priority dates.
