USCIS Updates EAD Validity Dates for TPS Designations: Burma, Ethiopia, South Sudan, Syria
USCIS has posted updates regarding Employment Authorization Document (EAD) validity dates for Temporary Protected Status (TPS) designations covering Burma, Ethiopia, South Sudan, and Syria.
USCIS has released updates concerning the validity dates of Employment Authorization Documents (EADs) for individuals covered under Temporary Protected Status (TPS) designations for Burma (Myanmar), Ethiopia, South Sudan, and Syria. These updates are intended to clarify when existing EADs remain valid and how affected individuals can maintain their work authorization during ongoing TPS periods.
TPS is a humanitarian immigration benefit granted to nationals of designated countries experiencing ongoing armed conflict, environmental disasters, or other extraordinary conditions. EADs issued under TPS allow beneficiaries to legally work in the United States for the duration of their protected status.
Affected TPS holders from these four countries should review the USCIS updates carefully to confirm the current validity of their EADs. In some cases, USCIS issues automatic extensions of EAD validity through Federal Register notices, meaning a document may remain valid beyond its printed expiration date.
Employers of TPS holders from Burma, Ethiopia, South Sudan, or Syria should also be aware of these updates to ensure proper I-9 employment verification compliance. Using an EAD that appears expired but has been automatically extended by USCIS policy remains legally compliant when the appropriate Federal Register notice is on file.
While TPS is distinct from EB-3 employment-based immigration, many TPS holders may simultaneously be pursuing or eligible for permanent residency pathways. Individuals should consult with a qualified immigration attorney to understand how TPS updates interact with any pending or planned immigrant visa petitions.

USCIS may blacklist applicants who attempt to game the H1B lottery through passport renewal, employer changes, or wage level manipulation, according to an official I-797C notice.
