The policy also introduces tighter timelines for responding to RFEs. Officers are no longer required to grant the standard 12-week response window and may set shorter deadlines on a case-by-case basis within regulatory limits. Additionally, the longstanding practice of providing an extra 14 days for internationally mailed notices has been eliminated; only the standard three-day mail extension now applies. For EB-3 petitioners and employers, a critical clarification is that submitting a partial response to an RFE or NOID will be treated as a request for a decision based on the record as submitted—meaning an incomplete response carries real denial risk. Despite the expanded denial authority, USCIS confirmed that RFEs are not being eliminated. Officers retain full discretion to issue them, especially in complex employment-based cases.
