The U.S. Citizenship and Immigration Services (USCIS) has issued a Federal Register notice dated August 19, 2026, announcing the extension of its currently approved information collection for Employment Eligibility Verification, commonly known as Form I-9. This extension carries no changes to the existing form or process, meaning employers and employees will continue using the same procedures for verifying work authorization.
The Employment Eligibility Verification form is a critical step in the EB-3 immigration process explained to all employment-based immigrants. Every employer in the United States is legally required to complete Form I-9 for each hired employee, including newly approved EB-3 green card holders and those on work-authorized visa statuses such as H-1B or EAD holders with pending adjustment of status applications.
For EB-3 applicants and green card holders entering the U.S. workforce, this notice signals continuity in I-9 compliance requirements. No new documentation requirements or procedural changes are being introduced, providing stability for both employers sponsoring foreign workers and the employees themselves.
The public has until September 18, 2026 to submit comments on this collection extension through Regulations.gov.
