The Department of Homeland Security has issued an alert confirming that Ukraine's Temporary Protected Status designation will be extended, though no specific new end date or formal designation period has been published. Previously, Ukrainian TPS was set to expire on October 19, 2026. Under federal law, TPS designations are automatically extended when the government does not act to terminate them — meaning current protections remain legally in place. Ukrainian nationals currently in the U.S. under TPS retain all existing rights, including authorization to remain in the country and valid employment authorization. USCIS has stated a formal announcement will be made "at the appropriate time," and beneficiaries are advised not to take any action to change their immigration status based solely on the current alert. For employers, the guidance is practical and immediate. Employers with Ukrainian TPS beneficiaries on staff should update I-9 records by noting "Extended per DHS announcement" in the Additional Information box. Employers must also monitor the USCIS TPS webpage (uscis.gov/tps) every few weeks for the official Federal Register notice that will confirm a new designation period and any updated EAD expiration dates. Critically, employers may not request additional documentation beyond what is listed on the Form I-9 Lists of Acceptable Documents — demanding proof of citizenship or TPS reregistration is prohibited. This I-9 compliance detail is particularly relevant for employers in EB-3 sponsorship pipelines who may also employ TPS workers. The absence of a specific end date introduces uncertainty for both workers and employers. Immigration practitioners recommend close monitoring of USCIS channels until a formal Federal Register notice is issued.
