USCIS has announced the publication of new editions of two critical immigration forms: Form I-539 (Application to Extend/Change Nonimmigrant Status) and Form I-765 (Application for Employment Authorization). Applicants who submit outdated versions of these forms after September 15, 2026 will have their applications rejected outright, with no opportunity for a Request for Evidence (RFE). This change is particularly significant for EB-3 applicants and their dependents who may be maintaining nonimmigrant status while awaiting green card processing. Form I-765 is commonly filed by EB-3 beneficiaries to obtain or renew Employment Authorization Documents (EADs) during the adjustment of status process. USCIS periodically updates its forms to reflect regulatory changes, improve data collection, or align with updated processing procedures. Using an expired or outdated edition is one of the most common and avoidable reasons for rejection, and unlike an RFE, a rejection means re-filing with additional fees. Applicants and their attorneys should immediately verify that they are downloading the latest edition directly from the official USCIS website (uscis.gov) before filing. The edition date is printed in the lower-left corner of each form page. Any forms prepared before this announcement should be discarded and re-completed using the new editions. USCIS strongly advises applicants to check the edition date carefully and plan filings accordingly to avoid costly and time-consuming rejections after the September 15 deadline.
