PERM Labor Certification 2026: Using Employer Experience for EB-3 Green Card

DOL regulations under PERM restrict using experience gained with the sponsoring employer to qualify for a position, but key exceptions exist for certain job restructurings and role changes.

The PERM labor certification process, administered by the Department of Labor (DOL), includes strict rules about what prior work experience qualifies an employee for the sponsored position. A central concern arises when the experience was gained while working for the same employer sponsoring the green card — a scenario that can raise red flags under 20 CFR 656.17(i). Under standard PERM rules, experience acquired with the sponsoring employer generally cannot be used to meet the minimum job requirements. This rule exists to prevent employers from tailoring job requirements specifically around a foreign worker's unique background in a way that would disadvantage U.S. workers during the recruitment process. However, DOL regulations do allow exceptions. Employer-gained experience may be credited if the sponsored position involves different and distinct job duties from the role in which the experience was acquired — meaning a meaningful change in responsibilities, not merely a title change. This typically applies when an employee moves from one department to another, or transitions from a technician-level to a professional-level role. For EB-3 applicants being sponsored by their current employer, careful documentation of job duty distinctions is critical. Immigration attorneys recommend clearly delineating how the prior role differed in scope, supervision, and responsibilities to withstand DOL scrutiny during a potential audit. Employers and applicants should work closely with qualified immigration counsel before filing PERM applications to ensure that experience qualifications are properly structured and defensible, especially in cases involving internal promotions or lateral role changes.
