The July 2026 Visa Bulletin brings significant news for employment-based immigrant visa applicants. USCIS has confirmed it will use the State Department's Final Action chart to determine Adjustment of Status (I-485) filing eligibility for the month, meaning applicants must compare their I-140 priority date against the published cutoff dates.
For most applicants, the news is positive: EB-3 All Chargeability Areas and Mexico advance two months from June 1, 2024, to August 1, 2024. China EB-3 moves forward to December 22, 2021, and India EB-3 inches ahead to January 1, 2014. However, the Philippines EB-3 remains frozen at August 1, 2023, with no movement this month.
India faces serious setbacks in higher preference categories. The EB-1 category for India retrogresses two months to October 15, 2022, due to high demand exhausting India's pro-rated limit. More critically, India's EB-2 category is now designated as 'Unauthorized' (U), meaning no visas will be issued in that category for the remainder of fiscal year 2026 (through September 2026).
For China, EB-2 remains unchanged at September 1, 2021, while EB-1 advances to June 1, 2023, and EB-3 continues its forward movement. All other countries not specifically listed remain current in EB-1 and EB-2 categories.
Employers are urged to immediately re-evaluate Adjustment of Status eligibility for foreign national employees, particularly those in EB-3 who may now be eligible to file due to this month's advancement. For pending cases in retrogressed categories, USCIS will pause adjudication but continue processing related EAD and Advance Parole requests.
