The EB-3 visa category provides a pathway to permanent residency in the United States for three distinct groups: skilled workers requiring at least two years of training or experience, professionals holding a U.S. bachelor's degree or equivalent, and other workers performing unskilled labor requiring less than two years of training. The EB-3 process is employer-sponsored, meaning a U.S. employer must initiate and support the petition on behalf of the foreign national worker. This relationship is central to the entire process, as the employer bears responsibility for filing the necessary applications and, in most cases, covering associated legal and filing fees. One of the most significant factors affecting EB-3 applicants is the multi-stage process, which typically includes PERM labor certification through the Department of Labor, followed by an I-140 immigrant petition, and finally adjustment of status or consular processing. Each stage adds time and complexity to an already lengthy journey.
