For EB-3 applicants with a pending I-485 adjustment of status application, transferring the underlying petition basis to EB-2 can be a powerful strategy — particularly when the EB-2 priority date is more current or advances faster. This process, sometimes called 'category upgrade,' allows applicants to leverage a new approved EB-2 petition without abandoning their existing I-485 filing date.
Timing is the most critical factor in this strategy. The transfer should only be initiated when the EB-2 category is actually current or about to become current for the applicant's country of chargeability. Moving too early — before the EB-2 date is favorable — could introduce unnecessary risk without any benefit. Practitioners advise monitoring the Visa Bulletin's 'Dates for Filing' and 'Final Action Dates' charts closely before making any moves.
Strategic considerations also include whether the new EB-2 position meets the same or substantially similar job requirements as the original EB-3 role.
