The Department of Homeland Security issued a sweeping interim final rule on October 14, 2026, making immediate changes to refugee status procedures and employment authorization. The rule, published at 91 Fed. Reg. 65077, cuts the time a refugee has to respond to a Notice of Intent to Terminate (NOIT) refugee status from 30 days to just 10 days. Public comments on the rule are due by November 13, 2026 (Docket No. USCIS-2026-0397). On the same day, USCIS separately ended the policy of automatically extending work permits for 'companion' visa holders — individuals whose employment authorization was tied to a principal applicant's pending case. This change has immediate practical consequences for thousands of foreign nationals currently awaiting adjudication of underlying immigration benefits. For EB-3 and other employment-based applicants with long-pending cases, the elimination of automatic companion EAD extensions means dependent family members may face gaps in work authorization. Affected individuals should consult with an immigration attorney promptly to file timely renewal applications and avoid lapses. The rule reflects the current administration's broader policy direction of tightening immigration procedures and reducing administrative flexibility. Both changes took effect immediately upon publication, leaving minimal time for affected individuals to adjust.
